1. Purpose
These terms govern access to guest-intelligence.com and the use of the Guest Intelligence SaaS platform operated by H HOLDING S.à r.l.
2. Acceptance
Use of the site and subscription to a plan constitute full acceptance of these terms. Customer purchase terms are not enforceable without prior written agreement from Guest Intelligence.
3. Plans and pricing
The Starter, Pro and Premium plans are described on the Pricing page. Prices are exclusive of tax. VAT is applied per applicable rules (intra-EU B2B reverse charge upon presentation of a VIES-validated VAT ID).
4. Commitment and termination
Minimum commitment: 6 months on monthly billing or 12 months on annual billing. Notice period: 30 days after the minimum commitment. If cancelled within 30 days after onboarding ends, setup fees are refunded.
5. Customer obligations
The customer agrees to provide accurate information, comply with applicable laws (notably GDPR for guest data), not attempt to bypass platform security, and pay invoices on time.
6. Service availability
Guest Intelligence aims for continuous availability. SLA 99% on Pro and 99.9% on Premium. Planned maintenance is announced at least 48 hours in advance.
7. Liability
Guest Intelligence's liability is capped at the amount actually paid by the customer over the 12 months preceding the triggering event. Indirect damages, loss of customers or revenue are excluded.
8. Governing law
These terms are governed by Luxembourg law. Any dispute falls under the exclusive jurisdiction of the courts of Luxembourg-City, save for mandatory public order provisions.
